Terms of Service

Welcome to Kolabl. These Terms of Service (“Terms”) govern your use of our website, mobile experiences, and services (collectively, the “Service”). By creating an account or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years old (16 in the European Economic Area) to use Kolabl. If you are under the age of legal majority in your jurisdiction, you confirm that a parent or legal guardian has read and agreed to these Terms on your behalf.

2. Your account

• You are responsible for maintaining the confidentiality of your account credentials.
• You agree to provide accurate information and to keep it current.
• You may not share your account, transfer it, or use anyone else's account.
• You are responsible for all activity that occurs under your account.

3. Use of the Service

You agree NOT to:

• Use the Service for any unlawful or fraudulent purpose
• Misrepresent yourself, your audience, or your content metrics
• Bypass, probe, scan, or otherwise circumvent any security feature
• Use automated systems (bots, scrapers, data miners) without explicit written permission
• Reverse-engineer, decompile, or attempt to extract source code from the Service
• Upload content that infringes third-party intellectual property, contains malware, is defamatory, or violates any law
• Harass, threaten, or impersonate any person on the Service
• Resell, sublicense, or commercialize the Service without our written consent

4. Connected platforms

When you connect Instagram or any other third-party platform, you confirm that you are the authorised owner or manager of that account and that you will comply with the terms of those platforms. We rely on the data those platforms make available to us; we are not responsible for changes, downtime, or limitations imposed by those platforms.

Data accessed from Instagram via our integration is used only for the purposes described in our Privacy Policy and never for advertising targeting, third-party profiling, or any purpose prohibited by Meta's Platform Terms.

5. Content and intellectual property

Your content

You retain ownership of all content you submit to Kolabl (your bio, portfolio, packages, posts you choose to feature, etc.). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and adapt that content as necessary to operate the Service.

Your public Media Kit

If you choose to publish a Media Kit, you make the information you select — including selected metrics derived from your connected accounts, your rate card, and posts you feature — publicly accessible at a shareable URL. You control what is published and may edit or unpublish it at any time. You are responsible for ensuring the information you publish is accurate and that you have the right to display it; misrepresenting your audience or metrics is prohibited under Section 3.

Our content

The Service (including code, design, dashboards, scoring algorithms, analytics methodology, and visual assets) is owned by Kolabl and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

6. Third-party services

Kolabl may display links or references to third-party platforms and services. We are not responsible for the content, policies, or practices of those third parties. Your interactions with them are governed by their own terms.

7. Deal mediation

If a creator and a brand disagree about a scope of work created through Kolabl, either party may raise the issue and Kolabl will provide good-faith mediation on request. Kolabl acts only as a facilitator in this process, not an arbitrator: we do not adjudicate who is right, issue binding rulings, or process payments between the parties. While an issue is open, the deal is paused.

To mediate, Kolabl may review the deal record — the agreed scope of work, timeline entries, deliverables submitted through the Service, and any notes or issue descriptions submitted through the Service in connection with the deal. The outcome of mediation is recorded on the deal and shared with both parties.

8. Fees

The core Service is free for creators today. We may introduce paid tiers or transaction fees in the future. We will notify you in advance and require explicit opt-in before charging any fee tied to your account.

9. Termination

You may close your account at any time from Settings or by emailing support@kolabl.com. We may suspend or terminate your account if you violate these Terms or engage in conduct that risks harm to other users or to Kolabl. Upon termination, your right to use the Service ends immediately, but provisions that by their nature should survive (intellectual property, disclaimers, indemnity, limitations of liability) will continue to apply.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. KOLABL DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS. ANALYTICS, RANKINGS, AND RECOMMENDATIONS ARE INFORMATIONAL ESTIMATES AND DO NOT CONSTITUTE FINANCIAL OR LEGAL ADVICE.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, KOLABL AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE. OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (a) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (b) ONE HUNDRED U.S. DOLLARS (US$100).

12. Indemnity

You agree to indemnify and hold harmless Kolabl, its officers, employees, and partners from any claim, demand, loss, or expense (including attorneys' fees) arising out of your breach of these Terms or your use of the Service.

13. Governing law

These Terms are governed by the laws of India, without regard to its conflict-of-law provisions. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Surat, Gujarat, India.

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified through the Service or by email at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
